Terms and Conditions (T&C)

1. Scope

These Terms and Conditions (hereinafter “T&C”) apply to all contracts between

(hereinafter “we”, “us” or “Seller”)

and the customer (hereinafter “you” or “Customer”) regarding the sale of goods via our online shop.

Any deviating conditions of the customer shall not be accepted unless we have expressly agreed to their validity in writing.

2. Contracting Party, Conclusion of Contract

2.1 Contracting Party

The purchase contract is concluded with Darius Pfarr, Wolfstalstraße 12, 31832 Springe, Germany.

2.2 Contract Language

The contract language is German.

2.3 Conclusion of Contract

The presentation of products in our online shop does not constitute a legally binding offer but a non-binding online catalogue.

The contract is concluded in the following steps:

  1. Cart: You place the desired items in the shopping cart
  2. Checkout: You click “Proceed to checkout” and enter your details
  3. Order: By clicking “Place order with obligation to pay”, you submit a binding offer to purchase the goods in your cart
  4. Order confirmation: You will receive an automatic email confirming receipt of your order (confirmation of receipt). This does not yet constitute acceptance of the offer
  5. Contract acceptance: The contract is concluded only when we accept your order by a separate email (order confirmation) or by shipping the goods

We reserve the right to reject orders without providing reasons.

3. Prices and Payment Terms

3.1 Prices

All prices are final prices and include statutory VAT. Additional shipping costs are shown before completing the order.

3.2 Payment Methods

We accept the following payment methods:

  • Credit Card (Visa, Mastercard, Maestro, American Express), PayPal, Klarna, Apple Pay, Google Pay, MobilePay, Bancontact, BLIK, EPS and UnionPay

Payment is due immediately upon order completion.

3.3 Late Payment

In case of late payment, we are entitled to charge statutory default interest.

4. Delivery and Shipping

4.1 Delivery Area

Delivery area: Germany and other countries. A full overview of all shipping zones and costs can be found on our shipping page.

4.2 Delivery Times

Delivery time is usually 3–5 working days after payment is received.

4.3 Shipping Costs

Shipping costs are shown before completing the order.

5. Retention of Title

The goods remain our property until full payment has been received.

6. Warranty

6.1 Warranty Rights

Statutory warranty rights apply. The warranty period is two years for new goods and one year for used goods from receipt.

6.2 Condition of Second-Hand Goods

As we sell second-hand items, they may show signs of wear. The condition of each item is stated in the product description.

6.3 Defect Reporting

Please inspect the goods immediately after receipt. Obvious defects must be reported within 2 days via email to ogfashioncheck@gmail.com.

6.4 Authenticity Guarantee

We guarantee the authenticity of all branded items sold. Each item is checked before sale.

7. Right of Withdrawal for Consumers

7.1 Withdrawal Policy

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day you receive the goods.

To exercise your right of withdrawal, you must inform us via email or post.

Consequences of withdrawal

We will reimburse all payments received within 14 days after receiving the cancellation notice.

Return shipping costs are borne by the customer.

Items must be returned in the same condition as received.

8. Liability

8.1 Liability for Defects

Statutory provisions apply.

8.2 Limitation of Liability

We are liable only for intent and gross negligence as well as under the Product Liability Act.

For slight negligence, liability is limited to essential contractual obligations and foreseeable damage.

9. Data Protection

Data processing is carried out in accordance with our privacy policy.

10. Dispute Resolution

10.1 Online Dispute Resolution

The EU Commission provides an online dispute resolution platform: https://ec.europa.eu/odr

10.2 Consumer Arbitration Board

We are not obliged and not willing to participate in dispute resolution proceedings.

11. Final Provisions

11.1 Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

11.2 Severability Clause

If any provision of these T&C is invalid, the remaining provisions remain unaffected.
