1. Scope
These General Terms and Conditions (hereinafter “T&Cs”) apply to all contracts between

(hereinafter “we”, “us” or “Seller”)
and the customer (hereinafter “you” or “Customer”) for the sale of goods via our online shop.
We do not recognise any conflicting terms of the Customer unless we have expressly agreed to their application in writing.
2. Contracting party, conclusion of contract
2.1 Contracting party
The purchase contract is concluded with OGFashioncheck GbR, represented by its partners Jamael Halimi and Darius Pfarr, Wolfstalstraße 12, 31832 Springe, Germany.
2.2 Contract language
The contract language is German.
2.3 Conclusion of contract
The presentation of the products in our online shop does not constitute a legally binding offer, but a non-binding online catalogue. The contract is concluded in the following steps:
- Shopping cart: You place the items you want in the shopping cart
- Checkout: You click “Checkout” and enter your details
- Order: By clicking “Place order with obligation to pay”, you submit a binding offer to purchase the goods in your shopping cart
- Order confirmation: You receive an automatic email confirming receipt of your order. This does not yet constitute acceptance of the offer
- Acceptance of contract: The contract is only concluded when we accept your order by a separate email or by dispatching the goods
We reserve the right to reject orders without giving reasons.
3. Prices and payment terms
3.1 Prices
All prices are final prices. In accordance with Section 19 UStG (small business regulation), no value added tax is charged or shown. Shipping costs are added, and are displayed before you complete your order.
3.2 Payment methods
We accept the following payment methods: credit card (Visa, Mastercard, Maestro, American Express), PayPal, Klarna, Apple Pay, Google Pay, MobilePay, Bancontact, BLIK, EPS and UnionPay. Payment is due immediately upon completion of the order.
3.3 Late payment
In the event of late payment, we are entitled to charge default interest at the statutory rate.
4. Delivery and shipping
4.1 Delivery area
We deliver to Germany and to other countries. A complete overview of all delivery zones and shipping costs can be found on our page Shipping Costs & Delivery.
4.2 Delivery times
We ship after receipt of payment. From receipt of payment, the delivery time is generally 3–5 working days within Germany, 5–9 working days to the other EU countries and 7–14 working days to countries outside the EU. These are guide values.
4.3 Shipping costs
Shipping costs are displayed before you complete your order. For orders of €50 or more, we deliver free of shipping costs within Germany and to the other EU countries. For countries outside the EU, we charge shipping costs even for orders of €50 or more.
4.4 Partial deliveries
Every item is a one-of-a-kind piece. If you order several items, we may deliver them in several shipments, provided this is reasonable for you. No additional shipping costs arise as a result.
5. Retention of title
The delivered goods remain our property until paid in full.
6. Warranty
6.1 Warranty rights
The statutory rights in respect of liability for defects apply. The warranty period is two years from delivery of the goods, including for used goods.
6.2 Condition of second-hand goods
As we sell second-hand items, they may show signs of wear. The condition of each item is stated in the product description. Please take note of this information before purchase.
6.3 Notification of defects
Please inspect the goods after receipt and notify us of any obvious defects by email at info@ogfashioncheck.com as promptly as possible. Your statutory warranty rights remain unaffected.
6.4 Authenticity guarantee
Before sale, we check every item for authenticity. If there are justified doubts about authenticity, we will refund the full purchase price if you contact us by email within 14 days of receipt. Your statutory rights remain unaffected.
7. Right of withdrawal for consumers
7.1 Withdrawal policy
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire after fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods.
To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email).
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
7.2 Exclusion of the right of withdrawal
The right of withdrawal does not apply to contracts for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

8. Liability
8.1 Liability for material defects and defects of title
The statutory provisions apply to material defects and defects of title.
8.2 Limitation of liability
We are liable without limitation for intent and gross negligence and under the Product Liability Act (Produkthaftungsgesetz). In cases of slight negligence, we are only liable for breach of an essential contractual obligation, i.e. an obligation the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which you may regularly rely, and for damage resulting from injury to life, body or health. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the typical, foreseeable damage. In all other respects, our liability is excluded.
9. Data protection
Your personal data is processed in accordance with our privacy policy.
10. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Final provisions
11.1 Jurisdiction and applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.
11.2 Severability clause
Should individual provisions of these T&Cs be or become invalid, this does not affect the validity of the remaining provisions.
